The Savage Self-Care Coach | Abigail Burton | ABN 12974423108
These terms cover group education programs, masterclasses, challenges delivered by Abigail Burton trading as The Savage Self-Care Coach, Victoria, Australia. In these terms, “Abigail” refers to Abigail Burton trading as The Savage Self-Care Coach, and “you” refers to the registered participant. They cover general education and coaching, not individual clinical care.
About your registration
These terms apply to group education programs, masterclasses, challenges and associated educational resources delivered by The Savage Self-Care Coach. One-to-one clinical consultations are governed by the separate Service Agreement.
The services, price, dates, inclusions and access arrangements for each program are stated in its offer and registration information. Platform and delivery-specific information, and any additional consent required for participation, are provided through that program’s registration and consent process. These terms apply alongside that information.
1 Nature of the program
Abigail provides general, evidence-informed education about nutrition, lifestyle, self-care and behaviour change within her qualifications and professional scope. Group questions are answered in general educational terms. The program does not provide individual clinical assessment or treatment, or services outside Abigail’s professional scope.
Participation does not establish an individual clinical consultation or replace individual healthcare or emergency care. One-to-one clinical consultations remain subject to the separate Service Agreement.
2 Eligibility and voluntary participation
Please register using accurate contact information. You can choose how much you take part in activities and discussions, including declining an activity or stopping at any time. You do not have to share health information, photographs, measurements or personal experiences.
The program is not a substitute for individual healthcare. If you have concerns about your physical, mental or emotional health, a health condition, are pregnant or breastfeeding, or take medication, seek advice from your treating practitioner before making changes that could affect your health. Do not stop or alter prescribed treatment because of program content.
For participants under 18, the involvement and consent of a parent or legal guardian is required, including for the intake process, provision of relevant health information and decisions regarding the minor’s healthcare. Any required additional consent must be obtained before participation.
3 Health decisions risks and outcomes
General information may not be suitable for your circumstances. Consider allergies, intolerances, existing conditions and your treating practitioner’s advice before changing your diet or lifestyle. Do not begin supplements or restrictive dietary practices on the basis of group discussion alone.
Changes may involve physical symptoms, emotional discomfort, practical or financial costs, and may not achieve the result you expect. Stop an activity that causes pain, distress or concerning symptoms and seek appropriate healthcare. Abigail does not guarantee weight loss, hormone changes, symptom improvement or any other particular result. Participation is an educational experience and does not promise a health transformation within the program timeframe.
Abigail provides the program with reasonable care, skill and professionalism, consistent with applicable law and her professional obligations. Your responsibility for your healthcare decisions does not remove Abigail’s obligations.
4 Access payment and communication
Your registration is personal. You must not share access links, accounts or paid resources, or transfer or resell your place without Abigail’s written permission. For paid programs, payment is required in full before delivery. The total price is disclosed before registration.
You need a compatible device, suitable internet connection and access to the advertised platforms. Refunds are not available for missed sessions or technical problems with your device, internet connection or other systems on your side, except where required by law. If a technical issue or circumstance outside your control prevents participation, contact Abigail promptly. Abigail may offer assistance or an alternative access arrangement at Abigail’s discretion; contacting Abigail does not create an entitlement to a refund, credit or make-up session. Recordings and make-up sessions are included only where expressly advertised. If Abigail cannot deliver an advertised inclusion, your rights under section 11 remain available.
Community groups and messages are not continuously monitored and must not be used for urgent health concerns. In a medical emergency contact local emergency services, including 000 in Australia.
5 Cancellations and refunds
You may cancel through the contact page on Abigail’s website and receive a full refund if your cancellation is received before the earlier of the program commencing or the release of any associated paid materials, recordings or resources. After that time, change-of-mind refunds are not available, except as required under Australian Consumer Law.
If Abigail cancels the program, Abigail will offer a full refund or an alternative you agree to accept. If Abigail materially reschedules or changes the program, Abigail will give as much notice as reasonably practicable and offer an alternative you agree to accept or a refund for the affected undelivered services. Your rights under Australian Consumer Law remain available.
6 Recordings
Sessions may be recorded. Where recording is planned, its purpose, what may be captured, how recordings will be used and the relevant participation options will be explained through the program’s registration and consent process. Appropriate recording consent will be obtained before recording begins. Recordings will be handled in accordance with the current privacy and confidentiality policy published on Abigail’s website and applicable law.
7 Privacy and group confidentiality
Personal information collected in connection with the program is handled in accordance with the current privacy and confidentiality policy published on Abigail’s website. Abigail collects information reasonably necessary to deliver and administer the services and will not disclose confidential information without appropriate consent, except where required by law or necessary to address a serious risk to health or safety. You may request access to your information, subject to applicable law.
You must respect the confidentiality of other participants. Information you voluntarily share in group discussions or community spaces may be visible to other participants. Do not disclose sensitive health information in a group setting or share another participant’s personal information outside the group without their consent.
8 Conduct and ending participation
Treat others respectfully. Abusive, threatening, discriminatory, harassing or disruptive behaviour, unsolicited promotion, unauthorised recording, and disclosure of others’ information are prohibited. Do not give other participants individual treatment or supplement instructions.
Abigail may moderate content or suspend or end access where conduct breaches these terms, required payment has not been received, or continued participation would be unsafe, unethical or outside Abigail’s scope. Where reasonably practicable, Abigail will explain the reason in writing and give an opportunity to resolve the issue. Immediate action may be needed to protect safety or privacy.
You may end participation by notifying Abigail. Any outstanding payments, unused services or refund entitlement will be assessed under these terms and Australian Consumer Law.
9 Intellectual property
Abigail’s slides, workbooks, guides, recordings and other educational materials remain Abigail’s intellectual property, except where third-party ownership is identified. You receive a non-exclusive, non-transferable licence for your personal educational use within any disclosed access period. You may retain materials expressly provided for download for that personal use.
You must not reproduce, publish, share, sell, license, teach from or commercially exploit Abigail’s materials without written permission, except where permitted by law.
10 Liability
Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy under Australian Consumer Law or other applicable legislation that cannot lawfully be excluded, restricted or modified.
Subject to those non-excludable rights, and to the fullest extent otherwise permitted by law, for a paid program Abigail’s total liability arising out of or in connection with these terms, however arising, is limited to the fees paid for the specific service giving rise to the liability. Subject to the same qualifications, Abigail is not liable for indirect, special or consequential loss, including loss of income, opportunity or expected results.
Nothing in these terms removes Abigail’s responsibility to exercise the care and skill required by law. You remain responsible for your own healthcare decisions.
11 Consumer rights complaints and applicable law
Your statutory rights remain available even after the program begins, materials are released, or participation ends. Where the law requires a remedy, these terms do not prevent a refund or another available remedy.
Use the contact page on Abigail’s website for questions or complaints. Abigail will first attempt to resolve a dispute through direct, good-faith discussion. If unresolved within a reasonable period, either party may give written notice describing the dispute and the outcome sought. This process does not prevent you contacting a regulator, seeking urgent relief or exercising a statutory right.
If a dispute remains unresolved following written notice, the parties irrevocably agree that any dispute, claim or proceeding arising out of or in connection with these terms or the program must be brought exclusively in the courts of Victoria, Australia, and each party irrevocably submits to the exclusive jurisdiction of those courts. This clause applies regardless of your country of residence or the location from which you access the program. These terms are governed by the laws of Victoria, Australia.
You may also contact the Health Complaints Commissioner Victoria where applicable. The Victorian Code of Conduct and complaints information will be made available with program registration. Your non-excludable rights under applicable legislation remain protected by sections 10 and 11.
12 Acceptance and changes
Before registering, read these terms, the offer and registration information and the current privacy and confidentiality policy published on Abigail’s website. Registration requires your affirmative acceptance. The terms and inclusions disclosed and accepted at registration apply to that program. Abigail will not materially reduce those inclusions or retrospectively change your rights without agreement, except where a change is legally required.
Recording notice
The live session, including Q&A, will be streamed into the private challenge Facebook Group and available there as a replay during the challenge. Participants will be removed from the group when the challenge ends, ending their access to the group and replay. After that, access to retained Facebook content is intended to be limited to Abigail and an authorised group administrator. Retained Zoom recordings are for Abigail only. You can participate without your image, voice or identifiable personal question being broadcast or recorded: keep your camera and microphone off, and ask general questions without personal health details. The host will answer questions without identifying participants. This is general education; personal health information is not required and should not be posted.
Privacy Policy
Purpose and Scope
This policy explains how Abigail Burton, trading as The Savage Self-Care Coach, collects, uses, stores, protects and discloses personal information and health information.
It applies to information collected from prospective, current and former clients, program participants, customers and other people who interact with The Savage Self-Care Coach.
Information I Collect
I collect only the information reasonably necessary to operate my business and provide services safely and effectively.
Depending on the nature of the interaction, this may include:
- name, contact details and identifying information;
- information provided through enquiries, prospective-client screening, enrolment and intake forms;
- health history, diagnosed conditions, symptoms, allergies, medications, supplements and relevant test results;
- dietary, lifestyle, sleep, stress, movement and health-goal information;
- consultation notes, recommendations, appointment history and service records;
- payment, invoice and transaction information; and
- correspondence, feedback and other communications.
How and Why Information Is Collected
Where reasonable and practicable, I collect information directly from the person it relates to. Information may be collected through website forms, questionnaires, consultations, email, telephone, messaging services, appointment-booking systems and payment providers.
Where services are provided to a person under 18, relevant information will be collected with the involvement and consent of their parent or legal guardian.
Information is collected and used to:
- respond to enquiries and assess suitability for services;
- provide clinical nutrition and related services;
- personalise services according to the client’s circumstances and goals;
- manage enrolment, appointments, payments and service-related communication;
- maintain appropriate records and support continuity and safety of care;
- meet legal, insurance and professional obligations; and
- operate and improve the business.
If information reasonably required for the safe provision of a service is not provided, I may be unable to accept the person as a client or provide some or all of the requested service.
Use and Disclosure
I treat personal information and health information as confidential.
Information may be used for the purpose for which it was collected or for a directly related purpose that the individual would reasonably expect.
Information will only be disclosed to a third party:
- where the individual has provided consent, including where they have authorised information to be shared with another healthcare professional;
- where disclosure is required or authorised by law; or
- where disclosure is reasonably necessary to address a serious risk to the health or safety of the individual or another person.
Service providers may handle information on my behalf where reasonably necessary to provide website forms, email, appointment booking, video consultations, payment processing or data storage. These providers are only given access to information reasonably required to perform their authorised function.
I do not sell or rent personal information.
Personal information will not be used for marketing unless the person has subscribed, consented or the communication is otherwise permitted by law. Marketing communications will include a way to unsubscribe.
Storage, Security and Retention
Information may be stored using secure electronic systems, including cloud-based service providers and encrypted local storage.
I take reasonable steps to protect information from loss, misuse, unauthorised access, modification and disclosure. Access to identifiable client information is limited to me and service providers requiring access to perform an authorised function.
Health records relating to an adult client will generally be retained for at least seven years after the last health service was provided. Health information collected while a client was under 18 will be retained until the client reaches 25 years of age or for at least seven years after the last health service was provided, whichever is later.
Other personal information will be retained only for as long as reasonably required or as required by law. When information may lawfully be disposed of and is no longer required, it will be securely destroyed or permanently de-identified.
Overseas Processing and Storage
Some service providers used by The Savage Self-Care Coach may process or store information outside Australia, including in the United States and other countries in which those providers operate.
Where information is handled outside Australia, I will take reasonable steps to use reputable service providers and safeguard the information in accordance with applicable privacy requirements.
Access and Correction
Individuals may request access to personal information or health information I hold about them and may request correction where information is inaccurate, incomplete, out of date or misleading.
Requests should be made in writing using the contact details below. I may need to verify the person’s identity before providing access or making a correction.
Access or correction may be limited or refused where permitted or required by law. If this occurs, written reasons will be provided where required.
Privacy Enquiries and Complaints
Privacy enquiries, requests to access or correct information, and complaints about the handling of personal information may be submitted through the contact form.
Please do not include detailed health information in the initial contact form submission. I will respond with an appropriate method for providing any additional information required.
I will acknowledge and investigate privacy complaints and aim to respond within a reasonable period.
If a person is dissatisfied with the response, they may contact:
- the Office of the Australian Information Commissioner at www.oaic.gov.au; or
- the Victorian Health Complaints Commissioner at www.hcc.vic.gov.au where the complaint concerns health information or the provision of a health service.
Applicable Law
Personal information and health information are handled in accordance with applicable laws, including the Privacy Act 1988 (Cth), the Australian Privacy Principles and the Health Records Act 2001 (Vic), including the Health Privacy Principles.
Policy Updates
This policy may be updated to reflect changes in legal requirements, business operations or the services and technology used by The Savage Self-Care Coach.
The current version will be made available through the business website. Where a change materially affects a current client, I will provide notice of the change.
